Johnson & Johnson and its subsidiary, Janssen Pharmaceuticals (J&J), will pay the federal government more than $2 billion in civil settlement and criminal fines to settle charges that Janssen Pharmaceuticals illegally marketed the blockbuster antipsychotic drug Risperdal®. Sheller, a mass torts and qui tam law firm, was the "first to file" in this case, representing a pharmaceutical sales representative who in the complaint claimed she saw evidence of illegal marketing of the antipsychotic for unapproved uses in children and the elderly. First approved for schizophrenia and specific types of bipolar mania, the complaint states that J&J made false and misleading statements about the safety of the drug, paid "kickbacks" to doctors, and promoted the drug for the unapproved uses of treatment for conduct disorders and ADD/ADHD in children and adolescents.
